Court Nullifies Omo-Agege's Suspension,Says His Punishment was Unconstitutional

You would recall that on Wednesday,the 17th day of April 2018,a good number of thugs interrupted the senate plenary and took away the mace,symbol of authority from the house.

The senate frowned at the fact that Omo-Agege who was suspended by the house came uninvited to the senate plenary and said it was unconstitutional. Taking his suspension to the court,the senate committee also frowned at it and gives a mark of punishment to Senator Omo-Agege.

The Federal High Court in Abuja yesterday nullified Omo-Agege's suspension,said it is unconstitutional. See below: 

 “While the legislator has powers to take disciplinary measures against its members, the reason given for the punishment is an unconstitutional reason'' Says Justice Nnamdi Dimgba as he was delivering his judgement. 

Then he gives his verdict: 

“I hereby nullify the suspension of the plaintiff (Omo-Agege) which was based on the recommendations of the Senate Committee on Ethics, Privileges and Public Petitions with immediate effect.”

The court made it clear that the decision recommended by the committee to punish Omo-Agege for going to court was wrong and that it contravened section 4 and 5 of the constitution :

“Access to court is one key indicator of a democracy, the exercise of his rights cannot be a basis for punishment.”

“In sanctioning a legislator, the legislature must act within the law. While this suit was pending and to the knowledge of the Senate and the Senate President, they went ahead and imposed a sanction on him

In the judgement yesterday,Omo-Agege happily described the judgement as a victory for democracy:

“We want the good people of this great nation to appreciate this victory for what it is. It is not a victory against the Senate, as there is no war against that great institution.''
